The MyPopCoins Loyalty (P) Ltd. (MyPopCoins/MPC) Member agrees that by completing the Registration Process for MyPopCoins or uploading an invoice from the MPC Retail Partner online or offline, he/she is deemed to have read and understood the terms and conditions of the Program and confirms that he/she is bound by these terms and conditions and any changes to it from time to time and such other terms as specified by MPC from time to time.
Membership into MPC Program is voluntary, open to all natural persons above the age of 18.
MPC reserves the right to modify these Terms and Conditions and such changes shall be deemed effective immediately upon posting of the modified Terms and Conditions on www.mypopcoins.com. Member’s continued use of the Program after any such changes constitutes Member’s acceptance of the new Terms & Conditions. If the Member does not agree to abide by the modified Terms & Conditions, then Member should not use or access (or continue to use or access) the Program. It is Member’s responsibility to regularly check the site www.mypopcoins.com to determine if there have been changes to these Terms & Conditions and to review such changes.
MPC membership is valid for lifetime of the MPC Member unless terminated in accordance with these terms and conditions.
MPC membership Account is not a payment medium or payment instrument.
MPC Members will be personally liable for any and all costs, taxes, charges, claims or liabilities of whatever nature arising from the provision or availability of benefits, facilities or arrangements provided or made available to a MPC Member, by MPC Retail Partners, as a result of his/her membership in the MPC Program.
MPC will endeavour to ensure that the services, benefits, facilities and arrangements as expressed or advertised by the MPC Retail Partners will be available to the MPC Members. However, MPC will not be liable for any loss or damage, whether direct or indirect, arising from the provision or non-provision whether whole or part, of any such services, benefits, facilities or any other arrangements by the MPC Retail Partners.
When a MPC Member seeks to use or obtain any of the services, benefits, facilities and arrangements as offered by the MPC Retail Partner, the provisions of such services, benefits, facilities or arrangements will be subject to the respective terms and conditions of the MPC Retail Partner, being the provider of the said benefits, facilities and arrangements.
MPC shall not be liable for any loss or damage, whether direct or indirect, resulting from termination or change of the MPC Program or any of its facilities, benefits or arrangements which are made available to the MPC Members, including without limitation, MPC Retail Partner's withdrawal or the withdrawal or limiting of any such services, benefits or facilities.
The Program of MPC may be modified at the sole discretion of My Popcoins Loyalty (P) Ltd. from time to time without intimation to the MPC Member.
MPC shall not be liable in the event it fails to fulfill any of its obligations under this terms and conditions due to flood, earthquake, storm, cyclone or any other acts of god of similar nature, war, strike, lockout, or governmental or judicial or quasi-judicial policies/intervention/direction /prohibition or change in law or for any other reasons beyond its control.
Any change in the account or contact details of an MPC Member is required to be made directly in the MPC app.
If a MPC Member fails to provide change of mobile number or email id information immediately, MPC or its Retail Partners will not be responsible for any loss/delay in delivery of the products/ services/loyalty points ordered/earned by the MPC Member.
All MPC Check-In data dispute complaints older than 15 Working Days from the date of the transaction will not be entertained.
The MPC Member acknowledges and understands that MPC is merely an intermediary and does not assume any liability or acquire any right, title or interest in the Schemes & Offers offered by MPC Retail Partners.
Enrollment and Usage
It is the MPC Members' responsibility to share the correct communication details with MPC at the time of enrolling into the Program
MPC shall reserve the right to offer the Program by invitation to any Prospective MPC Members as it may deem fit. Membership to the Program is at the sole discretion of MPC and it may refuse membership to any applicant without assigning any reasons.
MPC Retail Partners send Schemes & Offers to MPC Members via Facebook, App Notification, SMS and Email. By completion of Registration Process with the MPC Retail Partner, the Member is authorizing MPC and the Partner to send communication via SMS, Email, App Notification and Social Media messages. These communications include Schemes & Offers from the MPC Retail Partners where the Member is registered, key membership information and related offers from other MPC Retail Partners.
Schemes & Offers cannot be combined with any other rewards, offers, vouchers, third party certificates, coupons, or promotions, unless otherwise specified by the MPC Retail Partner.
Reproduction, sale or trade of any Schemes & Offers or offer code is prohibited.
MPC reserves the right to restrict the number of Check Ins and / or PopCoins awarded to a MPC Member in a day / week / month / year at its own discretion.
MPC reserves the right to add and/or remove Retail Partners into the Program.
MPC reserves the right to modify the PopCoins awarded to the Member for a Retail Partner or Non-Participating Retail.
Loyalty Points (PopCoins) awarded to Members are not a legal currency. PopCoins can be exchanged with gifts from MPC Retail Partners or Non-Participating Retails either Online or Offline subject to approval from such Retailer and MPC.
Any member shall have the right to transfer some or all of their PopCoins/points to another member or transfer Popcoins to the MPC retailer through the MPC App. Any such transfers made shall be final and not reversible.
MPC may award a certain number of PopCoins to a Member for visiting a Retail Partner or Non-Participating Retail. MPC reserves the right to decide the number of PopCoins to award the members. MPC may require the Member to share details of their Membership or details of visit to Retail Partner or Non-Participating Retail like bill receipt,etc. MPC may decide not to award the PopCoins to a Member. In that case, MPC will notify the Member the reason for the same. MPC reserves the rights to decide the rules and regulations of awarding the PopCoins.
MPC will notify these rules and regulations to the Members periodically through email, SMS, App Notifications or through website www.mypopcoins.com.
Third Party Services
You may register for the MPC Program using third party services (e.g., Facebook, Google, etc.) and otherwise enable various third party services to be directly integrated into your MPC Membership. By enabling third party services within the Membership, you are allowing MPC to pass your log-in information to these service providers for this purpose. Please remember that the manner in which third party services use, store and disclose your information is governed solely by the policies of such third parties, and MPC shall have no liability or responsibility for the privacy practices or other actions of any third party site or service that may be enabled within the Membership. In addition, MPC is not responsible for the accuracy, availability or reliability of any information, content, goods, data, opinions, advice or statements made available in connection with third party services. As such, MPC is not liable for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such third party service. MPC enables these features merely as a convenience and the inclusion of such features does not imply an endorsement or recommendation.
Termination of Membership
A MPC Member may terminate his/her MPC membership by contacting M/s My Popcoins Loyalty (P) Ltd. and requesting for termination.
Disqualification of a MPC Member, arising out of his/her misconduct, fraud and misuse of MPC Schemes & Offers or acts in a manner inconsistent with any central/state/local laws, statutes or ordinances, may result in immediate termination of MPC membership and cancellation of all MPC Retail Partners Schemes & Offers. MPC, Retail Partner and Non-Participating Retails reserve the right to take legal action against the Disqualified Members.
Intellectual Property Rights: Service Content, Software and Trademarks
MPC Member acknowledges and agrees that the Membership may contain content that is protected by copyright, patent, trademark, trade secret or other proprietary rights and laws. Except as expressly authorized by MPC, you agree not to modify, copy, frame, scrape, rent, lease, loan, sell, distribute or create derivative works based on the Membership or the content, in whole or in part. In connection with your use of the Membership you shall not engage in or use any data mining, robots, scraping or similar data gathering or extraction methods. Any use of the site www.mypopcoins.com or the content other than as specifically authorized herein is strictly prohibited. The technology and software underlying or related to the Service is the property of MPC, our affiliates and our partners (the “Software”). You agree not to copy, modify, create a derivative work of, reverse engineer, reverse assemble or otherwise attempt to discover any source code, sell, assign, sublicense, or otherwise transfer any right in the Software. Any rights not expressly granted herein are reserved by MPC.
Settlement of disputes: terms and conditions, set herein, shall be governed by the laws of India only. All disputes arising under the terms and conditions shall be attempted to be resolved through negotiations. Only in case, such negotiations are unsuccessful, the Member shall resort to legal recourse, which shall be subject to the exclusive jurisdiction of the competent courts in New Delhi only. All claims and disputes arising under the terms and conditions should be notified to MPC within 15 working days from the event date after which no MPC Member shall have any claim against MPC.
MPC or its Parent Company shall have the right to transfer, assign and sell in any manner, in whole or in part, the MPC Program to any third party of its choice without reference or intimation to the MPC Members.
MPC membership enrollment and eligibility and redeeming MPC Retail Partner Schemes & Offers are subject to the terms and conditions herein and are subject to any applicable laws and regulations. MPC reserves the right to terminate the Program, by giving 30 days notice to all MPC Members. MPC and MPC Retail Partners shall not be liable to any MPC Member or his/her nominee or companion, for any indirect or consequential loss, damage or expense of any kind whatsoever, arising out of or in connection with MPC, including the functioning of the mobile app, helpline and/or www.mypopcoins.com and/or provision or the refusal to provide any benefits, whether such loss, damage or expense is caused by the negligence or otherwise, and whether MPC and/or any of its MPC Retail Partners have any control over the circumstances giving rise to the claim or not.
All logos and trademarks on the MPC website, input devices, mobile apps and catalogs are owned by M/s My Popcoins Loyalty (P) Ltd.
Disclaimer of Warranties
Member’s use of the membership is at member’s sole risk. The membership is provided on an “as is” and “as available” basis. MPC expressly disclaims all warranties of any kind, whether express, implied or statutory, Including, But not limited to the implied warranties of merchantability, Fitness for a particular purpose, title and non-infringement. MPC makes no warranty that (I) The membership will meet member's requirements, (II) The membership will be uninterrupted, timely, secure, or error-free, (III) The results that may be obtained from the use of the membership will be accurate or reliable, or (IV) The quality of any products, services, information, or other material purchased or obtained by the member through the service will meet member's expectations.
Limitation of Liability
Member expressly understand and agree that MPC shall not be liable for any indirect, incidental, special, consequential, exemplary damages, or damages for loss of profits including but not limited to, damages for loss of goodwill, use, data or other intangible losses (Even if MPC has been advised of the possibility of such damages), whether based on contract, tort, negligence, strict liability or otherwise, RESULTING FROM: (I) The use or the inability to use the service; (II) The cost of procurement of substitute goods and services resulting from any goods, data, information or services purchased or obtained or messages received or transactions entered into through or from the service; (III) Unauthorized access to or alteration of Members’s transmission's or data; (IV) Statements or conduct of any third party on the service; or (V) Any other matter relating to the service. In no event shall MPC’S total liability to the member for all damages, losses or causes of action exceed the amount the member has paid MPC in the last three (3) months.
"MPC" and Retail Partners provide relevant offers and services to the MPC members who are interested in receiving these offers and services. To ensure that the offers and services are relevant MPC may solicit information from the members from time to time. This is solely for the purpose of making the program more and more meaningful. We are committed to protecting the privacy of our members and their transactions. This section explains how we protect and use your information in safe, secure and responsible manner. We value our member’s privacy.
Information We Collect:
When members interact with MPC through the Program, MPC may collect Personal Data and other information from then member, as further described below:
Personal Data That Members Provide Through the Program: We collect Personal Data from the members when he/she voluntarily provides such information such as when member registers for access to the Program, use certain Services, contact MPC with inquiries or respond to one of MPC surveys, information collected by Retail Partners and attached to Members. For example, we collect name, phone number, email address, third party service login credentials, and date of birth, etc.
Non-Identifiable or Aggregated Data: When members interact with MPC through the Program, we also receive and store certain personally non-identifiable information. Such information, which is collected passively using various technologies, cannot presently be used to specifically identify a member. MPC may store such information itself or such information may be included in databases owned and maintained by MPC affiliates, agents or service providers. MPC may use such information and pool it with other information to track, for example, the total number of visitors or users of the Program, numbers for our Partners, the number of visitors to each page of our website, the domain names of our visitors' Internet service providers, and how our users use and interact with the Program. Also, in an ongoing effort to better understand and serve the users of the Program, MPC may conduct research on its customer demographics, interests and behaviour based on the Personal Data and other information provided to us. This research may be compiled and analyzed on an aggregate basis. MPC may share this non-identifiable and aggregate data with its affiliates, agents and business partners, but this type of non-identifiable and aggregate information does not identify a member personally. MPC may also disclose aggregated user statistics in order to describe our services to current and prospective business partners, and to other third parties for other lawful purposes.

Retail Partners: To the extent you have obtained or redeemed a Scheme or Offer offered by a merchant (“Retail Partner”), or otherwise participated in any other activity sponsored or offered through the Program on behalf of the Retail Partner, we may provide such Retail Partners with your Personal Data (a) in order for the Retail Partner to redeem and validate your rewards, send you customized offers, troubleshoot redemption and combat fraud, (b) as part of legal proceedings affecting MPC and the Retail Partner, (c) to facilitate a direct relationship between the Retail Partner and you or (d) to enable the Retail Partner to communicate electronically with you with respect to Schemes & Offers related to such Retail Partner. Business Transfers: As we develop our business, we might sell or buy businesses or assets. In the event of a corporate sale, merger, reorganization, dissolution or similar event, Personal Data may be part of the transferred assets.
Agents, Consultants and Related Third Parties: MPC, like many businesses, sometimes hires other companies to perform certain business-related functions. Examples of such functions include maintaining databases, sending emails and SMS messages, offering and developing certain features of the Program, and maintenance and security. When we employ another company to perform a function of this nature, we only provide them with the information that they need to perform their specific function. We also disclose automatically collected data (card scans, promotional activities, and redemption information) to our Retail Partners, third-party ad servers and advertisers. These third parties may match this data with information that they have previously collected about you under their own privacy policies, which you should consult on a regular basis.
Legal Requirements: MPC may disclose your Personal Data if required to do so by law or in the good faith belief that such action is necessary to (i) comply with a legal obligation or assist government enforcement agencies, (ii) protect and defend the rights or property of MPC, MPC, Retail Partners, or our users, (iii) act in urgent circumstances to protect the personal safety of users of the Services or the public, (iv) protect against legal liability; (v) protect Rewards Providers from fraudulent, abusive, or unlawful uses; or (vi) protect the security or integrity of the Services.
With the Ability to Opt-Out: We do not share Personal Data with other third-party organizations for their marketing or promotional uses without your consent except as part of a specific program or feature for which you will have the ability to opt-out. We may offer contests that require you to take an action in order to receive a reward. This data is provided to the advertiser and you will always have the option to not participate.
The Program will automatically send you SMS, email, Facebook and other electronic messages with updates and other information as part of the Program. You may stop receiving SMS messages from the Program by contacting MPC.
Information shall be deemed to be non-confidential and MPC shall be free to reproduce, use, disclose, distribute and exploit such Unsolicited Information without limitation or attribution.
Integrating Third Party Services within the Program:
One of the special features of the Program is that it allows you to enable various online third party services, such as social media and social networking services (“Third Party Services”), to be directly integrated into your MPC experience. To take advantage of this feature, we will ask you to provide us your username and password for the relevant Third Party Services. By enabling such Third Party Services, you are allowing us to pass your log-in information to these service providers for this purpose. When you add a Third Party Service account to the Service, we will collect your login information and other relevant information necessary to enable the Service to access that Third Party Service and your data contained within that Third Party Service. However, please remember that the manner in which Third Party Services use, store and disclose your information is governed solely by the policies of such third parties, and MPC shall have no liability or responsibility for the privacy practices or other actions of any Third Party Service that may be enabled within the Service.
MPC takes reasonable steps to protect the Personal Data provided via the Services from loss, misuse, and unauthorized access, disclosure, alteration, or destruction. However, no Internet, email, mobile or other electronic transmission is ever fully secure or error free, so you should take special care in deciding what information you send to us in this way.
MyPopCoins Fair Usage Policy:
The member shall act responsible at all times and ensure that members availing of MPC Membership Service with respect to earning and redemption of PopCoins through Retail Partners (MPC Retails and Non-Participating Retails) shall do so in adherence to the MyPopCoins Fair Usage Policy (CFUP). The CFUP ensures that the redemption of PopCoins is in accordance to acceptable variance with Average Potential (AP) of members. Based on AP of our members, the MyPopCoins Fair Usage Limit (FUL) is established and conveyed to the members periodically. MyPopCoins monitors AP of our members from time to time and revises the FUL.
User acknowledges and agrees that PopCoins redemption in excess of FUL shall be a violation of CFUP and shall be deemed a breach of a material term hereof. Upon such violation the Company may suspend the User account with immediate effect.
Other Terms and Conditions:
Your access to and use of this Program is subject to MPC’s Terms & Conditions located at our website. MPC reserves the right to change the terms and conditions as and when deemed necessary. It shall be the responsibility of the Members to be familiar with the up to date terms and conditions found at www.mypopcoins.com.
